ROUTINE INSPECTION
OWNERSHIP CHANGE INFORMATION NEW FACILITY NAME: Bernal Bagels and Donuts NEW OWNER: Nineath Ben The applicant has completed the facility evaluation application process for an Environmental Health Permit. The permit category for this facility is FP10. An invoice for the permit fee in the amount of $1,107.00 will be mailed to the billing address on the application. Payment must be submitted within 10 days of receipt of the invoice. The owner is responsible for contacting our department if an invoice is not received and remit payment within 30 days. The Environmental Health Permit will be effective: 01/01/2025 - 12/31/2025. This report serves as a temporary permit. However, the permit will be deemed invalid if the permit fee is not paid in full within 30 days from the date of this report. Okay to Operate. An official permit will be mailed to the address on file and shall be posted in public view upon receipt. *Structural Review inspection conducted on 12/12/2024. *Permit condition: Replace floor, wall, ceiling with approved materials by 6/1/2025. *Obtain food safety manager certificate within 60 days. All other food employees must have valid food handler cards within 30 days from hire date.
FOLLOW-UP INSPECTION
This is a follow up inspection for the routine inspection conducted on 11/5/2024. Observations: K07: All PHFs were found at 41 or below at time of follow up inspection. K23: No evidence of rodent droppings were observed on the premises. Back storage area was found to be vermin proofed with holes sealed by a metal mesh and foam insulation. Facility is okay to open. Continue to work on all pending violations.
Facility changed ownership in October of 2023 and did not file for a Change of Ownership. --48 HOUR NOTICE— Our records indicate this facility is operating without a valid permit. Submit a permit application and Facility Evaluation Assessment form to our office or via email. Failure to comply within 48 hours will result in facility closure and additional enforcement, including but not limited to reinspection(s) and additional cost recovery fees. A facility found to be in continued operation without a permit may incur a penalty of three (3) times the operating permit fee, and fee(s) for re-inspection(s) charged at the current hourly rate approved by the Santa Clara County Board of Supervisors. Penalties and fees incurred due to enforcement activities must be paid in full prior to the issuance of an operating permit.
ROUTINE INSPECTION
Observed heavy staining on ceiling and walls near oven. [CA] Paint walls and ceilings white and monitor for ventilation issues. Facility may be subject to hood performance test.
Observed mop bucket located in front of back handwash sink. [CA] Keep handwash sinks clear and easily accessible at all times.
Observed rodent droppings in back storage room and by back delivery door. [CA] Eliminate pests from facility. Thoroughly clean and sanitize back storage room and all supplies. Discard any food that has been contaminated. Minimize all gaps and holes. Recommend working with professional pest control.
Observed raw shell eggs located in dry storage room that measured in the temperature danger zone (54F). Per PIC, the eggs were just delivered. [CA] Ensure deliveries of potentially hazardous foods are measured and put directly into refrigeration. [COS] PIC had staff put all the eggs into refrigerator.
