ROUTINE INSPECTION
(EDIT: 7/16/2026) This report was edited to reflect the corrected PR for the Macy's Men's Confectionary (PR0331061). Transferred from CO0160226. Confirmed facility does not need to submit for a new permit application. Updated report was emailed to the PIC. On-site to conduct a complaint investigation. The complainant alleged that rodents are present in the facility. Conducted walkthrough of Macy's Men's (3051 Stevens Creek) and Macy's Women's, including Starbucks (2801 Stevens Creek). During investigation, observed evidence of vermin activity at the Macy's Men's. The facility is hereby CLOSED by this department due to evidence of vermin infestation (see violation K13 and K23). Specialist directed PIC for all foods to undergo quality control, and for all foods to be stored in containers with tight-fitting lids to prevent further contamination or pest harborage. Facility must submit picture evidence of the food removed from facility or stored in containers to district specialist by 7/14/2026. During investigation, observed the Macy's Men's Department does not have any active permits for food operations. The last Environmental Health Permit for this facility location appears to have been inactivated. Per PIC, this permit was previously used for demonstration services at their kitchen and has since been inactivated. (NOTE: The only active Environmental Health Permit under 3105 Stevens Creek is for Starbucks @ Valley Fair, which is located on the Women's Department side: FA0230954, PR0331061 (FP76) and PR0455055 (FP09) Per PIC, the address for this facility is incorrect and should be listed under 2801 Stevens Creek.) Facility is hereby ordered to immediately CEASE AND DESIST all food services and operations at this location until facility obtains an active Environmental Health Permit by this Department. Facility shall submit a new permit application to dehweb@deh.sccgov.org within 48-hours of this notification, or the facility will be subject to further enforcement action. Facility is subject to a 25% penalty fee due to operating without a permit. Facility is additionally subject to the following requirements before re-opening following a vermin infestation: 1. Complete and sign the provided re-opening checklist. 2. Obtain pest control services and a copy of the latest pest control report from a licensed provider. 3. Submit the re-opening checklist and latest pest control report to district specialist (kathy.vo@deh.sccgov.org) or district supervisor (anjani.sircar@deh.sccgov.org). Upon review, district specialist will schedule the follow-up inspection. Per PIC, facility receives routine pest control services from Orkin. PIC stated that Orkin conducted services today. Reports are unavailable for review on-site. Requested copy of reports. A period of 24 hours from this inspection shall pass before requesting a follow-up inspection. Pest control treatments may require a sufficient amount of contact time to be effective. A facility found to be in continued operation without a permit may incur a penalty of three (3) times the operating permit fee, and fee(s) for re-inspection(s) charged at the current hourly rate approved by the Santa Clara County Board of Supervisors. Penalties and fees incurred due to enforcement activities must be paid in full prior to the issuance of an operating permit.

Observed Vermin: Documented in the following areas: - Gnaw marks on torn open bag of Macy's chocolate. - A few rodent droppings on the sales floor, on the sales table with foods, and inside the nearby register counter. - Numerous rodent droppings on the floor and shelving of the back storage area. Notification: The person in charge during inspection, Andrew, has been informed that the facility must close immediately. [CA]: The premises of each food facility must be maintained free of vermin. A facility cannot operate if there is a vermin infestation that leads to contamination of food contact surfaces, packaging, utensils, food equipment, or adulteration of food. The facility is required to cease operations immediately and must remain closed until all corrective actions on the provided checklist are completed.

On the sales floor, observed bag of chocolate peanuts is torn open with gnaw marks and more than halfway empty. [CA] Food is adulterated if it bears or contains any poisonous or deleterious substance that may render it impure or injurious to health and shall be discarded immediately. [COS] PIC removed the contaminated food from the sales floor.
