On-site to conduct a follow-up to the routine inspection from 9/9/2025. The following major violations have been corrected: - K07: Proper hot and cold holding temperatures. Observed all foods at proper holding temperatures. See measured observations. - K18: Compliance with variance/ROP/HACCP. --- Observed all meat and seafood for sale is now stored in plastic containers. Soups are now stored in plastic resealable Ziploc bags. Facility stated that meat, seafood, and soup will no longer be vacuum sealed. --- Observed several vegetables have been vacuum sealed and stored in display coolers for sale. All vegetables are properly labelled with the production time and date and held at 41F or lower. If facility elects to continue using ROP, facility must submit a standard operating procedure which complies with the following standards: (1) The food is labeled with the production time and date. (2) The food is held at 41 degrees Fahrenheit or lower during refrigerated storage. (3) The food is removed from its package in the food facility within 48 hours after packaging. --- PIC stated that facility will not be vacuum sealing vegetables or any items moving forward. Continue to address remaining violations as cited on the routine inspection report.

ROUTINE INSPECTION

Facility is conducting on-site reduced oxygen packaging (ROP) for raw and cooked meat and seafood products using commercial vacuum sealer without an approved hazard analysis critical control program (HACCP) or standard operating procedure (SOP). The meat and seafood is marinated or cooked on-site, cooled down, then vacuum packaged for storage into refrigeration or in the freezer. Food facility must acquire a HACCP plan with the California Department of Public Health or submit SOP prior to continuing ROP on-site. (Seafood, including fish and octopus, is prohibited from ROP.) NOTE: A food facility is not required to have a HACCP plan if food facility uses ROP method which complies with the following standards: (1) The food is labeled with the production time and date. (2) The food is held at 41 degrees Fahrenheit or lower during refrigerated storage. (3) The food is removed from its package in the food facility within 48 hours after packaging. Facility is required to submit an SOP to this department if facility elects to follow these procedures. A follow-up inspection to verify compliance of major violations will be conducted within 3 business days. The first follow-up inspection is free of charge. Subsequent follow-up inspections after the first follow-up shall be billed at $298/hour during normal business hours (Monday - Friday, 7:30 AM to 4:30 PM), and $645/hour during non-business hours, and upon inspector availability. --48 HOUR NOTICE— Our records indicate this facility is operating without a valid permit and has a delinquent account. Your balance due is $1,975.00. Payment must be made immediately to DEH at the address at the top of this report or via our website at www.ehinfo.org. A facility that submits payment of the outstanding balance within 48 hours (2 business days) of this notice will be issued and mailed an operating permit by this department. Failure to comply within 48 hours will result in facility closure and additional enforcement, including but not limited to reinspection(s) and additional cost recovery fees. A facility found to be in continued operation without a permit may incur a penalty of three (3) times the operating permit fee, and fee(s) for re-inspection(s) charged at the current hourly rate approved by the Santa Clara County Board of Supervisors.     Measured 25 ppm chlorine sanitizer concentration in the mechanical dishwasher. [CA] Mechanical sanitization shall be accomplished in the final sanitizing rinse with 50 ppm chlorine, or as per manufacturer's specifications.

A food facility that packages potentially hazardous food using a ROP method must operate under a HACCP plan which has been approved by the California Department of Public Health. [SA] PIC agreed to open all foods that have been have vacuum sealed for less than 48 hours, and transfer to a plastic Ziplog bag during inspection. Food facility must acquire a HACCP plan with the California Department of Public Health or submit SOP prior to continuing ROP on-site.

    Observed a modified rack surrounding ONLY hand wash station in prep area. Equipment/utensils are stored around hand wash station. [CA] Relocate rack, hand wash station shall be accessible at all times and ensure all clean equipment/utensils are free from potential contamination.
